Dear Madam,

RE: YOUR DEFAMATION OF OUR PRINCIPAL, DOUGLAS OGBANKWA ESQ., ON MULTIPLE SOCIAL MEDIA PLATFORMS – DEMAND FOR IMMEDIATE RETRACTION AND APOLOGY


I act as Solicitor for myself, having been briefed as legal counsel to your child’s father, Kelvin Uyi Martins. In the course of performing my professional duties, you have made several defamatory, injurious, and malicious statements against my person on social media. These constitute serious legal infractions.

Below are the issues in contention:

1. Defamatory Social Media Publications

You recently circulated multiple videos, using my photographs, and made several false, disparaging, and damaging remarks on Facebook and other cyberbullying platforms. Your statements include, but are not limited to, the following allegations:

“The lawyer is challenging the Judge in Court.”

“The lawyer is threatening Judges in Benin because he belongs to one thing or the other.”

“He has godfathers in the police and in different political parties.”

“You have a lawyer doing all sorts of dirty things for you in Benin.”

“A Court where the lawyer is threatening the Judges… he has godfathers in politics.”

Multiple other baseless statements suggesting judicial manipulation, misconduct, and unethical behaviour.

You further alleged that cases were transferred due to my interference and made unfounded claims involving the former Attorney General, Dr. Samson Osagie, insinuating impropriety regarding the entry of a Nolle Prosequi.

2. Public Ridicule and Damage to Reputation

Your publications have subjected me to ridicule, odium, and public disesteem among right-thinking members of society.

3. Knowledge of Falsity

You were fully aware that your allegations are false. I merely acted in my lawful role as counsel to Kelvin Uyi Martins.

4. Clarification on Nolle Prosequi

Your statements concerning Dr. Samson Osagie are equally false. I petitioned the Attorney General’s office with verifiable facts, and after due review, a Nolle Prosequi was properly entered in accordance with the Constitution.

5. Abuse of Court Process

While the matter is pending at the Court of Appeal, Benin, you filed a divorce suit at the Ikpoba-Okha Area Customary Court, Ologbo. Upon learning that my client appeared through counsel, you withdrew the suit when the Court did not sit.

6. Continuous Malicious Attacks

Instead of awaiting the outcome of the Court of Appeal matter, you have continued to defame my name, person, honour, and professional reputation.

7. My Professional Standing

I have built my reputation over the years through professionalism and dedication. I hold several local and international positions of honour, including:

Director of Strategic Communications, African Bar Association

Coordinator, African Bar Association Law Students Internship Programme

Former Publicity Secretary, Nigerian Bar Association, Benin Branch

Team Lead, NBA-SPIDEL National Public Interest Litigation Committee, Edo State

Founder and President, Benin Writers Society

Convener, Security Situation Room

Public Affairs Analyst on VOA, SABC, Channels TV, News Central, NTA, AIT, Inspiration FM, among others.

8. Assault and Further Falsehoods

On 7th January 2023, you assaulted me in the presence of senior police officers, including the Area Commander Benin Metro (ACP Angelo Akaro, Rtd.) and IPO David Igene. Upon being granted bail, you fled to the AIG Zone 5 Headquarters, where you fabricated false narratives. This matter remains pending before the Court of Appeal, Benin.

9. Collaboration with Third Parties to Defame Me

In September 2023, you connived with Nosa Eghe, owner of TMC Media, to publish false and defamatory content about me and my client on multiple platforms including YouTube, Facebook, WhatsApp, and Instagram, particularly at the NUJ Press Centre, Edo State.

10. False Allegation of Child Theft

You released a video calling my client, Kelvin Uyi Martins, a “baby thief” and deliberately placed my photograph beside him, misleading the public into associating me with the alleged offence.

11. My Patience Exhausted

Despite your continued attacks, I have maintained silence. However, enough is enough.


DEMANDS

You are hereby given 21 days to:

1. Publish a clear and unequivocal retraction and public apology on all social media platforms and newspapers where you defamed me; and

2. Pay the sum of ₦500,000,000.00 (Five Hundred Million Naira) as compensation for the damage to my name, reputation, and professional standing.

Failure to comply will leave me with no choice but to commence legal action before a court of competent jurisdiction, claiming ₦1,000,000,000.00 (One Billion Naira) for your malicious, deliberate, and sustained attempt to de-market and injure my person and professional integrity.


Be advised: the wheels of justice may turn slowly, but they turn surely. Whether you are brought to justice or justice is brought to you, justice will prevail.

Every act of impunity has an expiry date.
